Welcome to Apartey, a community-powered rental intelligence and property insight platform operated by Homesynq OÜ, a company registered under the laws of the Republic of Estonia (17214159) (“Apartey,” “we,” “our,” or “us”).

By creating an account, accessing, or using any part of the Apartey platform, website, mobile application, or related services (“Services”), you confirm that you have read, understood, and agree to be legally bound by these Terms of Use (“Terms”), along with our:

• Community Guidelines
• Copyright Policy
• Agency Terms (if applicable)

If you do not agree to these Terms or related policies, you must not access, register an account or use the Services.

2. Scope of Services

Apartey provides a digital information and community platform that allows users to:

• Share verified home reviews and rental experiences
• Browse and list long-term rental or property sale listings
• View aggregated housing insights, analytics, and trends
• Engage with landlords, tenants, and property managers
• Participate in the Apartey Keys Rewards program
• Post or discover passive home swap listings

Important: Apartey is not a real estate broker, booking agent, or intermediary. We do not own, manage, or control any property listed on our platform and do not participate in, facilitate, or guarantee any user-to-user transaction, swap, or agreement.

3. User Responsibilities

• Provide truthful, accurate, and lawful information.
• Use the platform only for lawful purposes.
• Not impersonate or misrepresent yourself or any property.
• Respect others’ rights, privacy, and intellectual property.
• Immediately notify Apartey of unauthorized or suspicious activity.

4. Prohibited Conduct and Content

• False, misleading, or defamatory content
• Personal information or images without consent
• Offensive, discriminatory, or unlawful material
• Fraudulent or scam-related content
• Copyright or trademark-infringing material

Violation of these rules may result in content removal, account suspension, or termination at Apartey’s sole discretion.

5. Content Ownership and License

• Users retain ownership of all content they post on Apartey.
• By posting, you grant Apartey a non-exclusive, royalty-free, worldwide license to use, reproduce, and display your content to operate and improve our services.
• You warrant that you own or have the right to submit such content.

6. Content Moderation and Enforcement

• We moderate content using automated tools and human review.
• We may edit, hide, or remove violating content.
• We may suspend or terminate accounts for violations.
• All moderation decisions are final and at our sole discretion.

7. Home Swap Listings

• Platform Role: Apartey provides a listing and discovery feature for users but does not facilitate or guarantee swaps.
• No Involvement in Agreements: Users are responsible for their negotiations, due diligence, and compliance.
• No Transaction Processing: We do not process or hold payments.
• No Guarantee of Outcome: We make no guarantee that listings will lead to successful matches.
• User Responsibility: Users must ensure swaps comply with leases and local laws.
• Visibility Upgrades: Paid features only enhance visibility, not guarantee results.
• Points and Rewards: Points may only offset platform fees, not be transferred or used for swaps.

8. Disclaimer of Liability

• All user-generated content reflects users’ opinions only.
• We do not guarantee accuracy or completeness of user content.
• We are not responsible for third-party conduct or disputes.
• The Services are provided “as is” without any warranties.
• Users must exercise independent judgment when relying on content.

9. Limitation of Liability

• Apartey is not liable for indirect, incidental, or consequential damages, including loss of profits, data, or goodwill.
• Total liability shall not exceed €100 or the total fees paid to Apartey in the past 12 months.

10. Indemnification

You agree to indemnify and hold harmless Apartey, its affiliates, employees, and directors against any claims, losses, or damages arising from:

• Your breach of these Terms or other policies
• Your misuse of the Services
• Your violation of any law or third-party rights
• Any content you submit that causes harm or infringement

11. Termination

Apartey may suspend or terminate your account for violations of these Terms, misuse, or legal obligations. Upon termination, your access ceases immediately, but indemnification and limitation clauses survive.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Estonia. All disputes shall be resolved exclusively in the courts of Estonia.

13. Modifications to Terms

Apartey may modify these Terms at any time. Updated versions will be posted with a new effective date. Continued use of the platform indicates acceptance of the changes.
